Acceptance of these Terms
These Terms of Service govern your access to and use of TextTheCaller, including our website, applications, features, and related services. By creating an account, subscribing to a plan, accessing the platform, or otherwise using the service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the service.
If you are using the service on behalf of a business, company, partnership, sole trade, or other organisation, you confirm that you have the authority to bind that entity to these Terms. In that case, references to “you” and “your” mean both you as an individual and the organisation you represent.
About the Service
TextTheCaller is a software service designed to help users automatically send text messages to callers after a missed call or attempted call event. The service may rely on call forwarding, carrier routing, telephony providers, webhooks, messaging gateways, and other technical integrations in order to function.
TextTheCaller does not provide your mobile service, phone number, SIM, network access, or call forwarding infrastructure unless expressly stated otherwise. You are solely responsible for ensuring that your phone setup, carrier forwarding configuration, device settings, and connected numbers are correctly configured and remain functional. You are also responsible for any charges, fees, or costs imposed by your mobile carrier, network provider, or other third party in connection with call forwarding, incoming calls, outgoing messages, or related services.
We may add, remove, improve, modify, suspend, or discontinue features of the service at any time, with or without notice, where reasonably necessary for business, legal, security, or technical reasons.
Eligibility and Account Registration
You must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, and capable of entering into a legally binding agreement in order to use the service. By registering for an account, you confirm that the information you provide is accurate, complete, and kept up to date.
You are responsible for maintaining the confidentiality and security of your login credentials and for all activity that occurs under your account, whether or not authorised by you. You must notify us promptly if you believe your account, password, or connected phone number has been accessed, used, or compromised without permission.
We reserve the right to refuse registration, suspend accounts, reclaim usernames, or require identity or account verification where reasonably necessary to protect the platform, comply with legal obligations, or prevent fraud, abuse, or misuse.
Your Responsibilities
You are responsible for your use of the service and for all messages, content, phone numbers, call-routing settings, autoresponder text, and other materials or data you submit, configure, transmit, or make available through TextTheCaller.
You must ensure that you have all rights, permissions, and legal authority required to use the service in relation to the relevant phone number, caller interactions, and automated messages. This includes making sure that any text message sent through the service complies with applicable laws, regulations, industry rules, and carrier requirements, including rules relating to privacy, direct marketing, electronic communications, consumer protection, spam, and consent.
You are responsible for keeping your automated message accurate, appropriate, lawful, and up to date. You must also ensure that your contact information, billing details, and account details remain current so that we can administer the service and contact you where necessary.
If you use the service for business purposes, you remain solely responsible for your customer communications, disclosures, sales practices, support obligations, record-keeping, and legal compliance.
Acceptable Use
You may use TextTheCaller only for lawful purposes and in accordance with these Terms. You must not use the service in any way that is fraudulent, deceptive, abusive, misleading, threatening, defamatory, harassing, discriminatory, unlawful, or otherwise harmful.
You must not use the service to send spam, unsolicited marketing communications where prohibited, scams, phishing messages, impersonation attempts, malicious links, false offers, misleading claims, unlawful promotions, or content that infringes the rights of any person or organisation. You must not use the service in connection with emergency services, medical emergencies, or any situation where delayed, missed, or failed communication could create a risk to health, safety, property, or life.
You must not interfere with, disrupt, probe, scan, copy, scrape, reverse engineer, decompile, attempt to extract source code from, or otherwise misuse the platform, infrastructure, or related systems except where such restriction is prohibited by law and cannot legally be excluded. You must not attempt to bypass security measures, rate limits, account restrictions, billing controls, message restrictions, or technical safeguards.
We may investigate suspected misuse and take any action we reasonably consider necessary, including restricting access, suspending message delivery, removing content, suspending or terminating accounts, reporting activity to service providers or regulators, or cooperating with law enforcement.
Message Content and Compliance
You retain responsibility for the wording and content of any automated text-back message you configure. TextTheCaller does not provide legal advice and does not guarantee that any template, example, suggestion, or generated wording is legally compliant in your jurisdiction or industry.
You must ensure that your messages do not contain unlawful marketing content, deceptive statements, regulated claims, prohibited promotions, offensive material, or content that infringes intellectual property, privacy, confidentiality, or other third-party rights. Where consent, notice, or opt-out language is required by law or regulation, it is your responsibility to ensure that your use of the service meets those requirements.
We may, but are not obliged to, filter, monitor, flag, block, or remove messages or accounts where we believe content may present legal, reputational, carrier, deliverability, fraud, or abuse risks.
Call Forwarding and Telecom Dependencies
TextTheCaller may depend on conditional call forwarding, missed-call forwarding, rejected-call workflows, telecom routing logic, or similar features offered by third-party carriers and telecom providers. These services are outside our control. We do not guarantee that call forwarding will be available on your network, will remain enabled, will operate consistently, or will be supported on all devices, plans, numbers, regions, or carriers.
You are solely responsible for setting up and maintaining your forwarding configuration correctly. If forwarding is disabled, misconfigured, unsupported, interrupted, or changed by you, your carrier, your device, or a third party, the service may not function properly. TextTheCaller is not responsible for missed messages, failed triggers, duplicate events, delayed texts, failed call detection, or unexpected call handling caused by network behaviour, carrier limitations, handset settings, SIM swaps, number porting, voicemail rules, or other telecom-related issues.
Billing, Subscriptions, and Payments
Certain features of the service may require payment of subscription fees, usage-based fees, add-on charges, taxes, or other applicable charges. By purchasing a paid plan, you authorise us and our payment processors to charge the applicable fees using your chosen payment method.
Unless otherwise stated, subscriptions renew automatically at the end of each billing cycle until cancelled. You are responsible for cancelling your subscription before renewal if you do not wish to continue. Cancellation will usually take effect at the end of the current paid billing period, unless otherwise required by law. Deleting your account, stopping use of the service, or disabling forwarding does not automatically cancel your paid subscription unless the billing system expressly confirms cancellation.
You remain responsible for any charges incurred before cancellation takes effect, including subscription renewals, usage charges, message fees, taxes, telecom costs, and any carrier or provider fees outside our control. If your payment method fails, expires, is declined, or cannot be charged, we may suspend or restrict access to paid features until payment is successfully collected.
Fees are non-refundable except where required by applicable law or where we expressly agree otherwise. We may change pricing, plans, usage allowances, or billing structures from time to time. Where required, we will provide reasonable notice before material pricing changes take effect.
Fair Use, Limits, and Restrictions
We may apply usage limits, fair use controls, message caps, rate limits, number verification requirements, anti-abuse filters, or other restrictions to protect the reliability, legality, and security of the service. These limits may apply per account, per user, per number, per destination, per billing cycle, or per event type.
If your usage is unusually high, inconsistent with normal use, likely to affect platform stability, or suggestive of spam, automation abuse, fraud, or unlawful activity, we may restrict functionality, delay processing, require verification, move you to a different plan, or suspend access.
Any stated message allowance, included volume, or feature limit is subject to those controls and may change over time as part of service development or abuse prevention.
Text messages are only sent to callers who have attempted to call your forwarded number and fit the criteria for triggering the service. You must not attempt to use the service to send messages to recipients who have not called your number, or to send messages in bulk, as part of a marketing campaign, or in a way that may be considered unsolicited or spam. The criteria may include, but is not limited to, the caller’s number being recognised as a valid phone number, the call being forwarded to the service, the caller having not received a message from the service within a certain time frame, and the caller not being on a blocklist or suppression list.
Prohibited Uses
You must not use the service to send messages that are unlawful, fraudulent, deceptive, abusive, harassing, defamatory, threatening, discriminatory, infringing, or otherwise harmful. You must not use the service to send spam, scams, phishing messages, impersonation attempts, malicious links, false offers, misleading claims, unlawful promotions, or content that infringes the rights of any person or organisation.
We may prohibit or restrict use of the service in response to certain types of keywords, content, patterns, or behaviours that we reasonably believe present legal, reputational, carrier, deliverability, fraud, or abuse risks. This may include political content, regulated claims, health-related content, financial offers, or other categories of content that are commonly associated with abuse or legal risk.
Moderation and Enforcement
We reserve the right to investigate and take appropriate action against suspected violations of these Terms, including without limitation, issuing warnings, restricting access, removing content, suspending or terminating accounts, reporting to service providers or regulators, or cooperating with law enforcement.
Our enforcement of these Terms is at our sole discretion and may be based on various factors, including the severity of the violation, the risk of harm, the impact on other users or carriers, and our business priorities. We are not obligated to take any specific action in response to a violation, and we do not guarantee that we will detect or prevent all violations.
We have a zero-tolerance policy for certain types of abuse, including spam, scams, phishing, impersonation, unlawful marketing, and content that poses a risk to health, safety, or legal compliance. We may take immediate action against accounts or content that we reasonably believe are involved in such abuse.
Service Availability and No Guarantee
We aim to provide a reliable service, but we do not guarantee uninterrupted availability, error-free performance, message delivery success, or compatibility with all carriers, devices, browsers, jurisdictions, or use cases. Message delivery and event detection depend on many factors outside our control, including mobile networks, number validity, handset settings, carrier filtering, message throughput rules, outages, routing behaviour, and recipient restrictions.
The service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, representations, and conditions not expressly stated in these Terms, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, satisfactory quality, non-infringement, and uninterrupted operation.
TextTheCaller is not an emergency communications platform, life-safety service, guaranteed delivery service, or regulated telecommunications provider unless expressly stated otherwise.
Third-Party Services and Integrations
The service may rely on or integrate with third-party services, including without limitation telecom providers, SMS gateways, cloud hosting platforms, analytics providers, payment processors, customer support tools, authentication services, and other technology partners. We are not responsible for the acts, omissions, outages, policies, fees, security practices, or performance of those third parties.
Your use of third-party services may also be subject to separate terms, conditions, and privacy notices imposed by those providers. If a third-party provider suspends, changes, restricts, or discontinues a dependency that affects TextTheCaller, we may be unable to continue providing part or all of the service, and we will not be liable for resulting disruption, feature changes, or loss of functionality.
Suspension and Termination
You may stop using the service at any time. If you wish to fully stop automated text responses, you should both cancel any paid subscription and disable any relevant call forwarding or telecom routing settings on your device or carrier account.
We may suspend, restrict, or terminate your access to the service immediately, with or without notice, if we reasonably believe that you have breached these Terms, failed to pay fees when due, created legal or operational risk, engaged in misuse or abuse, infringed the rights of others, or used the service in a way that may harm us, other users, carriers, providers, or third parties.
We may also suspend or terminate the service, or any part of it, for business, legal, security, abuse-prevention, or technical reasons. Upon termination, your right to use the service will cease immediately, but provisions of these Terms that by their nature should survive termination will continue to apply, including provisions relating to payment obligations, intellectual property, disclaimers, liability limits, indemnity, and dispute resolution.
Intellectual Property
TextTheCaller and all related software, designs, branding, logos, interfaces, documentation, site content, and underlying technology are owned by us or our licensors and are protected by intellectual property laws. Except for the limited right to use the service in accordance with these Terms, no rights are granted to you by implication, estoppel, or otherwise.
You retain ownership of the original text, content, and materials you submit to the service. However, you grant us a non-exclusive, worldwide, royalty-free licence to host, copy, process, transmit, adapt, and use that content solely as necessary to operate, maintain, improve, secure, and provide the service, enforce these Terms, and comply with legal obligations.
You must not use our name, branding, trademarks, or other proprietary materials without prior written permission, except where such use is strictly necessary to identify the service in a truthful and non-misleading way.
Data Handling and Privacy
Your use of the service may involve the processing of phone numbers, message content, timestamps, event logs, billing information, technical metadata, and other account-related information. Our handling of personal data is governed by our Privacy Policy, which should be read alongside these Terms.
You are responsible for ensuring that your own use of the service, including any caller communications and personal data you process through it, complies with applicable data protection and privacy laws. Where required, you must provide appropriate notices and obtain any necessary permissions or lawful basis for such processing.
Force Majeure
We are not responsible for any delay, interruption, underperformance, or failure to perform resulting from causes beyond our reasonable control. This includes carrier outages, telecom failures, internet disruption, denial-of-service attacks, labour disputes, power failures, infrastructure failures, platform outages, government action, legal restrictions, civil unrest, natural disasters, epidemics, and other force majeure events.
Limitation of Liability
To the fullest extent permitted by law, TextTheCaller and its owners, officers, employees, contractors, affiliates, licensors, suppliers, and service providers will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, or for any loss of profits, revenue, business, goodwill, data, customers, contracts, opportunities, or anticipated savings arising out of or related to your use of, or inability to use, the service.
We are also not liable for message non-delivery, delayed delivery, failed call detection, carrier filtering, routing errors, failed forwarding, loss of business leads, missed sales, reputational harm, customer complaints, device misconfiguration, third-party outages, or unauthorised access to your account caused by your failure to maintain account security.
To the fullest extent permitted by law, our total aggregate liability for any and all claims arising out of or relating to the service or these Terms will not exceed the total amount paid by you to TextTheCaller in the twelve months immediately preceding the event giving rise to the claim. If you have not paid any amount to us during that period, our total liability will be limited to £100.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
Indemnity
You agree to indemnify, defend, and hold harmless TextTheCaller and its owners, officers, employees, contractors, affiliates, licensors, and service providers from and against any claims, demands, actions, proceedings, liabilities, losses, damages, judgments, settlements, penalties, fines, costs, and expenses, including reasonable legal fees, arising out of or related to your use of the service, your content, your messages, your telecom setup, your breach of these Terms, your breach of applicable law, or your infringement of any rights of a third party.
Changes to the Service or Terms
We may update, amend, or replace these Terms from time to time. Where changes are material, we will take reasonable steps to provide notice, such as by posting an update on the website, sending an email, or notifying you through the service. The updated Terms will take effect on the stated effective date.
Your continued use of the service after updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the service and cancel your subscription.
We may also modify, replace, suspend, or discontinue any aspect of the service at any time, temporarily or permanently, where reasonably necessary.
Governing Law and Disputes
These Terms, and any non-contractual disputes or claims arising out of or in connection with them or the service, are governed by the laws of the jurisdiction in which TextTheCaller is established, unless mandatory local consumer law requires otherwise.
You agree that the courts of that jurisdiction will have exclusive jurisdiction to resolve disputes arising out of or relating to these Terms or the service, unless applicable law gives you the right to bring a claim in another court that cannot be excluded by contract.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
General Provisions
These Terms constitute the entire agreement between you and TextTheCaller in relation to the service and supersede any prior discussions, understandings, or agreements relating to the same subject matter.
Our failure to enforce any provision of these Terms is not a waiver of that provision or any other right. You may not assign, transfer, or sublicense your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations where reasonably necessary as part of a business reorganisation, sale, merger, acquisition, or transfer of assets.
